FY23 Capital Spending Plan

The mayor's office has released their Capital Spending Plan (CSP) for the FY 23 Calendar year. You can take a look at the filed Resolution here (RS2021-1201). In a media release, the mayor touts the CSP, saying that they are focused on neighborhoods. It's a $1 Billion CSP.

I've combed through the proposed CSP and here are some of the highlights I found and wanted you to review...

  • $250,000 is allocated to a Master Plan for a new Hadley Park Library Branch
  • $1.28M for new garbage trucks and repairs
  • $45M for "Restoration & Resiliency, Partnership Funding (Jefferson Street Cap) I'm not sure why this wasn't spelled out completely in the CSP. I will follow up and send you any thoughts from the mayor's office and NDOT.
  • $5M for Safety/Vision Zero/Traffic Calming - Entire County
  • $5M For sidewalk construction - Entire County
  • $2M for the North Nashville/Bordeaux Participatory Budgeting

I'm concerned that this CSP doesn't have enough items listed for District 21. Traffic calming and infrastructure are items the District has shared with me. I do not believe NDOT has received enough funding to be able to manage the needs of the entire county nerveless the district. 

What's Happening Tonight

Several months ago, Mr. Jon Cooper, Metro Council's Director and Legal Counsel, retired from Metro. There is a Resolution (RS2021-1198) authorizing a new Director, Ms. Margaret Darby. We will also confirm several appointments to Boards and Commissions. If you are interested in serving our great city as an appointed board or commission member, please reach out to me directly.

We have a host of Public Hearings tonight as well. I have several zoning items that will be heard this evening.

BL2021-922 - I will defer this bill tonight for it to track with Metro Planning Commission. This bill defines, in metro's code, what a "bar and nightclub" is and how it differs from a restaurant. It also will implement a condition requiring a 100 feet distance of any bar and nightclub from parcels containing single family residential, two family residential, day care center (up to 75), day care center (over 75), day care home, school day care, orphanage, monastery or convent, religious institution, or community education.  

BL2021-931 An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from IR and OR20 to SP zoning on properties located at 704 41st Ave N, 4105 Clifton Avenue and Clifton Avenue (unnumbered), 4018 Indiana Avenue, and 4020 Indiana Avenue, approximately 475 feet west of 40th Ave N, (5.11 acres), to permit 112 multifamily residential units, all of which is described herein (Proposal No. 2021SP-004-001).

BL2021-932 - This is an updated bill due to a new state law that passed. It is an action that will be taken with BL2021-931. An ordinance to authorize building material restrictions and requirements for BL2021-931, a proposed Specific Plan Zoning District located at located at 704 41st Ave N, 4105 Clifton Avenue and Clifton Avenue (unnumbered), 4018 Indiana Avenue, and 4020 Indiana Avenue, approximately 475 feet west of 40th Ave N

BL2021-937 - An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CS and RS5 to SP zoning for properties located at 2100, 2105 and 2107 Buchanan Street, on either side of Buchanan Street and approximately 85 feet west of Clarksville Pike (1.12 acres), to permit a mixed use development. I will add an amendment to remove the bar and nightclub usage and any outside amplified music.

BL2021-938 - This is an updated bill due to a new state law that passed. It is an action that will be taken with BL2021-937.

BL2021-943 - An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CS and MUG-A to SP zoning for properties located at 2410, 2412 and 2416 West End Avenue and 2413 Elliston Place, at the northeast corner of West End Avenue and 25th Avenue South (0.87 acres), to permit a mixed used development. I'll add an amendment to this bill as well. 

BL2021-946 - This will be deferred by rule - The applicant did not send out proper notice for the zoning. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, A request to rezone from R6 and CS to SP zoning for properties located at 1919, 1924 and 1928 9th Avenue North, at the southeast and southwest corners of Clay Street and 9th Avenue North (1.12 acres), to permit a mixed use development.

BL2021-950 - An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CF to MUI-A zoning for properties located at 1904, 1906, 1908, 1910, 1912, 1912B and 1916 Hayes Street.

BL2021-953 - An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by applying a Detached Accessory Dwelling Unit (DADU) Overlay District to various properties located south of Clay St. and Lacy St., north of Scoval St., east of 26th Ave. N., and west of Interstate 65, zoned CN, CS, R6, R6-A, RS5, and SP. There is a housekeeping amendment that will be added.

BL2021-958 - An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from CS to MUL-A zoning for property located at 626 40th Ave N, at the southeast corner of Clifton Avenue and 40th Ave N.

Here are a few other items on tonight's agenda I think you should follow.

RS2021-1191 - A resolution recognizing the North Nashville/Bordeaux Participatory Budgeting Steering Committee and Process.

RS2021-1201 - This is the Capital Spending Plan communicated above.

BL2021-971 - This ordinance will create an Office of Housing and Homelessness.

The following are Bills discussing License Plate Readers legislation

BL2021-841 - This ordinance, as amended, amends Section 13.08.080 of the Metropolitan Code pertaining to the use of LPR in the public rights-of-way. This ordinance generally prohibits LPR usage by Metro for scanning plates in the right-of-way, except as specifically allowed in the ordinance. This limitation would only apply to Metro and LPR could still be used by the public.

 

Metro would be authorized to use LPR in law enforcement vehicles, for emissions testing, and for parking enforcement. LPR could be used by law enforcement to scan, detect, and identify license plate numbers for the purposes of identifying: 

                     Stolen vehicles

                     Vehicles associated with missing or endangered persons

                     Vehicles registered to a person with an outstanding felony arrest warrant

                     Vehicles for which a probable cause search warrant for a felony offense has been obtained

BL2021-961 - 

The ordinance would require departments, either directly or through contractors, who want to use LPRs to implement a usage and privacy policy that would be posted on the department’s website. The policy must be designed “to ensure that the collection, use, maintenance, sharing, and dissemination of LPR information is consistent with respect for individuals' privacy and civil liberties.” The data collected could only be used for the following purposes:

                     investigating and prosecuting criminal offenses

                     detecting and parking civil traffic or parking offenses

                     operating a smart parking or curb management program

                     assisting in missing persons cases including Amber and Silver Alerts
